General Terms and Conditions

Welcome to the website of OnDrive Ltd., registered in the Republic of Bulgaria. These General Terms and Conditions govern the relationship between OnDrive Ltd. and the users of the web pages and services available on our website https://ondrive.bg/. By accepting the General Terms and Conditions, you agree that your personal data will be processed on the basis of the contract concluded between you and the Merchant.

OnDrive Ltd. is a company registered under the Commercial Act of the Republic of Bulgaria with UIC 207306051, address: Bulgaria, Varna, Mladost district, Hristo Smirnenski Street 29, phone +359 87 531 32 39.

I. Scope of activity

OnDrive Ltd. offers car repair and car service services, including technical maintenance of vehicles, trade in spare parts, consumables and accessories for motor vehicles, domestic and foreign wholesale and retail trade, commercial representation, intermediation and agency, e-commerce, purchase of goods for resale in their original, processed or treated form, production, information and advertising services, consulting and commission activities, as well as any other commercial activities not prohibited by law. All services are described in detail in the "Services" section of our website.

II. Rights and obligations of the user

Users of the website are obliged to use the information and services provided in accordance with Bulgarian legislation. Any attempts at unauthorised access, damage to information or violation of system security are prohibited. 

Every natural person has the rights granted to him by the Consumer Protection Act (promulgated in SG No. 99 of 9 December 2005, as amended and supplemented), insofar as it is applicable to the relations between OnDrive Ltd. and the User regulated by these General Terms and Conditions.

III. Personal data protection

OnDrive Ltd. is committed to protecting the personal data of its customers. All information provided by users is processed in accordance with the Personal Data Protection Act and the General Data Protection Regulation (GDPR). The collection and processing of personal data is carried out based on the consent of the Users to whom the personal data relates. The provision of any personal data by the Users is voluntary, with a view to the Users’ use of the functionalities of the Website. When processing personal data, OnDrive Ltd. adheres to the following principles, namely that personal data shall be:

1. processed fairly, in a transparent manner with regard to the data subject and lawfully;

2. collected for specific, legitimate and explicitly stated purposes and not further processed in a way incompatible with those purposes; further processing for archiving purposes in the public interest, for scientific or historical research or for statistical purposes shall, in accordance with Article 89(1) of Regulation (EU) 2016/679, not be considered incompatible with the initial purposes;

3. adequate, relevant to the purposes for which they are processed and limited to what is necessary in relation to those purposes;

4. accurate and, where necessary, kept up to date; to ensure the timely erasure or rectification of inaccurate personal data, all reasonable measures must be taken, bearing in mind the purposes for which they are processed;

5. stored in a form which permits identification of the data subject for no longer than is necessary for the purposes for which the personal data are processed; insofar as they are processed solely for archiving purposes in the public interest, for historical or scientific research or for statistical purposes in accordance with Article 89(1) of Regulation (EU) 2016/679, personal data may be stored for longer periods, provided that appropriate technical and organisational measures, as laid down in Regulation (EU) 2016/679, are applied in order to safeguard the rights and freedoms of the data subject;

6. processed in a manner that ensures an appropriate level of security of the personal data, including protection against unlawful or unauthorised processing and against accidental loss, damage or destruction, by applying appropriate organisational and technical measures;

7. subject to accountability for compliance with the obligations of OnDrive Ltd. arising from the applicable personal data protection legislation.

OnDrive Ltd. selects and applies appropriate technical and organisational measures that ensure the protection of the personal data processed against intentional damage or unauthorised access, as well as in the event of any other unlawful processing of personal data (accidental or unlawful destruction, alteration, loss, access to transferred, stored or otherwise processed personal data, or unauthorised disclosure).

If you prefer not to receive electronic messages with information about products and services from OnDrive Ltd. or its External suppliers, please notify OnDrive Ltd. that you wish to opt out of receiving such information.

IV. Cookies

When you visit the Website, information that is not personal may be automatically stored on your computer in the form of “cookies”. Thanks to this information, the Website recognises you and remembers your preferences. In this regard, OnDrive Ltd. will use cookies to monitor the number of visits to the Website, to determine whether your visit is the result of a specific marketing campaign, the type of Internet browser you use or the website from which you arrived. 

The stored “cookies” cannot identify you or read data from your hard drive. They help OnDrive Ltd. tailor its communications to customers’ preferences and improve the Website (for example, by seeing which pages are popular and which are not).

V. Intellectual property

The intellectual property rights to all resources and materials located on the website of OnDrive Ltd. (including the available databases) are protected under the Copyright and Related Rights Act, belong to OnDrive Ltd. or to the respective person indicated that has granted OnDrive Ltd. the right to use them, and may not be used in violation of the applicable legislation.

In the event of reproduction or copying of information beyond what is permitted, as well as any other infringement of intellectual property rights over the resources of OnDrive Ltd., OnDrive Ltd. shall be entitled to claim compensation for the direct and indirect damages suffered in full.

Except where explicitly agreed otherwise, the User may not modify, reproduce, alter, distribute, disclose or otherwise publish the information resources published on the website of OnDrive Ltd.

OnDrive Ltd. undertakes to exercise due care to ensure that the User has the possibility of normal access to the services provided.

OnDrive Ltd. reserves the right to suspend access to the services provided. OnDrive Ltd. has the right, but not the obligation, at its sole discretion to delete information resources and materials published on its website.

OnDrive Ltd. reserves the right to make changes to these General Terms and Conditions at any time, without being obliged to give any notice to the Users. The changes take effect immediately upon their publication on the website.

In accordance with the provisions of the applicable personal data protection legislation, every User:

• has the right to be informed on the questions raised that are related to the processing of his personal data;

• has the right of access to his personal data;

• has the right to supplement and rectify the personal data collected about him, including by adding a declaration;

• has the right to erasure of his personal data that have been processed;

• has the right to restrict the processing of his personal data;

• has the right to the portability of his personal data;

• has the right to object to the processing of his personal data;

• has rights related to automated individual decision-making, including profiling.
